By March 2019, the scheme will be fully open for EU citizens to apply for settled status in the wake of Brexit should you wish to continue living in the UK after June 2021.
To be eligible to apply to settled status you’ll need to:
- Be an EU citizen or family member of an EU citizen
- Have been living in the UK continuously for the last 5 years
- Have started living in the UK by 31 December 2020
If you have lived in the UK for less than 5 years, you will be eligible to apply for ‘pre-settled’ status.
You must have been living in the UK for 5 years continuously subject to certain limited exceptions. You must have lived in the UK for at least 6 months each year in the 5 year period.
Once securing pre-settled status, you will be allowed to continue to reside in the UK until you have lived here for 5 years when you will be eligible to apply for settled status based on your 5 years continuous residence. As a citizen with pre-settled status, you will still be entitled to work and access public funds and the NHS.
Procedure and Fees
The process will be an online procedure costing £65 if you are 16 and over or £32.50 if you are under16. Please note that these fees are subject to approval by Parliament.
Permanent Residence or Indefinite Leave to Remain
If you have either of these already, it will be free for you to swap your status to settled or pre-settled status.
The deadline to apply for settled or pre-settled status will be 30 June 2021.
